Welcome to The UXologist. These Terms of Service ("Terms") govern your access to and use of our website, AI-assisted tools, and educational content. By using The UXologist, you agree to comply with these Terms.

1. Introduction

The UXologist provides educational content and AI-assisted tools to help users understand and apply cognitive biases and psychological principles in product and business design.

2. Definitions

  • "We", "us", "our" refers to The UXologist.
  • "User", "you" refers to anyone accessing our services.
  • "Content" includes all text, images, AI-generated insights, and user-submitted materials on The UXologist.
  • "Services" refer to our website, AI tools, educational materials, and paid subscription plans.

3. Account Registration & Access

  • Users may access limited free content without registration.
  • A free account grants access to additional resources like lab studies and psychology cheat sheets.
  • Casual plan subscribers can access full content on bias and principle pages.
  • Pro plan subscribers gain access to the AI-assisted Shaker Tool.
  • Accounts must be registered with a valid email address.

4. Subscription & Payments

  • We offer Free, Casual, and Pro plans, available on a monthly or annual subscription basis.
  • Payments are processed via Stripe; The UXologist does not store payment details.
  • If a subscription is cancelled, access remains until the end of the billing cycle.
  • If a payment fails, users will be notified and must update payment details before the subscription expires.

4.a. Experience Psychology Review Services

The UXologist offers a separate paid service called Experience Psychology Review, which provides a professional analysis of digital product experiences using cognitive psychology principles.

Scope & Delivery:

  • Services include UX flow reviews, cognitive bias analysis, improvement suggestions, redesign examples, and strategy recommendations.
  • Each review is tailored based on the plan selected (Starter, Focused, or Complete), and scoped using user-provided materials.
  • Delivery time estimates are provided based on current availability and are confirmed after the request is reviewed.
  • Reports are delivered via PDF, with additional materials like Figma files, Loom walkthroughs, or Notion documentation depending on the plan or add-ons selected.

Payment & Refunds:

  • These services are quoted and paid in advance, separate from subscription plans.
  • All quotes are based on estimated hours and scope. If the scope changes, a new quote may be issued.
  • Due to the custom nature of this work, refunds are not offered once work has commenced. Partial refunds may be considered before delivery only if significant delays are caused by The UXologist.
  • Add-ons (such as strategy calls, follow-up reviews, or design outputs) are priced separately unless included in the original plan.

Client Responsibilities:

  • Clients must provide accurate information, links, and access (including paid access if required) to ensure the review can be conducted effectively.
  • The UXologist is not responsible for delays caused by missing, incorrect, or inaccessible materials.
  • Client files and flows are treated as confidential and used solely for the purposes of the agreed-upon review.

Limitation of Liability:

  • The UXologist provides experience psychology reviews as professional guidance, not as a guarantee of business performance or conversion rate improvements.
  • Clients are responsible for deciding how to apply recommendations.

5. Refund Policy

Refunds are only granted under the following conditions:

  • Technical failures preventing access to paid features.
  • Mistaken payments (e.g., incorrect plan selection).
  • Auto-renewal refunds if requested within 48 hours of renewal (first-time requests only).
  • No refunds will be issued for used services.
  • No partial refunds for annual plans.

6. Content Ownership & Usage

  • The UXologist owns all content, including AI-generated outputs.
  • Users cannot copy, redistribute, or resell content.
  • User-submitted content (e.g., case studies) may be used by The UXologist only within educational contexts.

7. Prohibited Activities

Users must not:

  • Scrape, copy, or redistribute content.
  • Share paid content with non-subscribers.
  • Misuse the AI tool (excessive use defined as 10 queries per hour, 10 per day, 300 per month).
  • Engage in harassment, offensive behavior, or unethical application of insights.
  • Attempt to bypass subscription restrictions (e.g., account sharing).

8. Data Collection & Privacy

  • We collect: First name, last name (optional), email, work type, role, company details, goals, referrer.
  • Data is retained as long as the user has an account.
  • Users can request data deletion via account settings.
  • Google Analytics is used for website optimization; users may opt out via an initial prompt.
  • We do not sell or share user data beyond Stripe (payments) and MailerLite (email marketing).

9. Disclaimers & Liability

  • No Guarantee of Results: Our content and tools provide guidance but do not guarantee business success.
  • AI Content is for Guidance Only: AI-generated insights should not replace professional advice.
  • Not Liable for Business Decisions: Users are responsible for their own decisions based on our content.
  • Third-Party Services: We are not responsible for issues with Stripe, MailerLite, or other integrations.

10. Account Suspension & Termination

We may suspend or terminate accounts for:

  • Non-payment after the billing cycle ends.
  • Violating these Terms (e.g., content scraping, misuse of AI tools).
  • Abuse or misconduct affecting platform integrity.
  • Legal or compliance obligations.

11. Governing Law & Jurisdiction

  • These Terms are governed by the laws of England and Wales.
  • Disputes will be resolved in UK courts.

12. Updates & Notifications

  • We may update these Terms at any time.
  • Users will be notified via a temporary banner on the website and email.
